Decision not to confirm Provisional Order

On 7 August 2024, the Authority made a Revocation Order in accordance with section 25(7)(c) of the Electricity Act 1989 and Section 28(7)(c) of the Gas Act 1986. The Authority is satisfied that Maxen Power Supply Ltd have taken the steps necessary in order to comply with the requirements set out within the provisional order.

Issue of Provisional Order

On 10 May 2024, the Gas and Electricity Authority (“the Authority”) issued a Provisional Order with respect to apparent contraventions by Maxen Power Supply Limited (“Maxen Power”) in accordance with section 25(2) of the Electricity Act 1989 and 28(2) of the Gas Act 1986. It appears to the Authority that Maxen Power is contravening or is likely to contravene Standard Licence Conditions (“SLCs”) 0A and 4A of its Gas and Electricity Supply Licences.

This follows an ongoing Enforcement investigation into Maxen Power opened in November 2023. The Authority is concerned that Maxen Power does not have the capability to comply with its relevant legislative and regulatory obligations and that they are not treating customers in the manner required.

The Provisional Order sets out the actions that Maxen Power is now required to take to improve its compliance position. These actions include not taking on any new customers whilst the order is in place and commissioning a full independent audit of its processes.
