NOTICE OF REVOCATION OF A LICENCE PURSUANT TO SECTION 7A WITH REASONS PURSUANT TO SECTION 38A OF THE GAS ACT 1986
Notice of Revocation
Whereas
1. Acorn Peach Energy Ltd (company registration number 10117252), having its registered office at Kemp House, 160 City Road, London, EC1V 2NX, United Kingdom, is the holder of a Gas Shipper Licence (“the Licence”) granted or treated as granted under section 7A(2) of the Gas Act 1986 (“the Act”).
2. Section 7B(3) of the Act provides that a licence granted or treated as granted under the Act may be revoked in accordance with any term contained in it.
3. Schedule 2(1)(e)(i) to the Licence provides that the Gas and Electricity Markets Authority (“the Authority”) may at any time revoke the Licence on giving not less than 30 days notice to Acorn Peach Energy Ltd where it has ceased to carry on its business as a gas shipper.
4. The Licensee has ceased to carry on its business as a gas shipper.
Reasons for Decision
5. The Authority has decided that the Licence should be revoked in accordance with paragraph 1(e)(i) of Schedule 2 of the Licence because the Licensee has ceased to carry on its business as a gas shipper.
6. On 24 February 2022, the Authority decided that the Licence should be revoked in accordance with paragraph 1(e)(i) of Schedule 2 of the Licence because the Licensee has ceased to carry on its business as a gas shipper.
7. On 8 March 2022, the Licensee made representations to the Authority seeking a withdrawal of the Authority’s decision to issue a Notice of Revocation of the Licence. The Licensee stated that “As of February 24, Acorn Peach Energy Limited had not ceased to carry on business as a Gas Shipper”. The Licensee made a number of claims stating that it had not ceased to carry on its business as a gas shipper.
8. On 25 March 2022, the Authority decided to withdraw the Notice of Revocation dated 24 February 2022 and requested the licensee to provide specific evidence by close on 19 April 2022 at the latest demonstrating that it is still active as a gas shipper.
9. Acorn Peach Energy Ltd responded to our request on 5 April 2022 but failed to provide evidence that it is active as a gas shipper.
Therefore
10. The Authority hereby gives notice that, unless the Authority otherwise directs, with effect from 24 May 2022, the Licence shall be revoked.
